VERO BEACH — A Miami man is charged with lewd and lascivious battery on a 15-year-old girl who developed the herpes virus from the encounter in January in Indian River County, according to sheriff's reports.
Marlon Arita, 28, was arrested at 4:15 p.m. Sunday at the Indian River Mall and put in the Indian River County Jail.
According to an arrest affidavit, the two met in December and then on Jan. 1 went to a hotel on 90th Avenue, Vero Beach, and had sexual relations. He gave her an iPod touch so they could stay in touch, and he took her to Fort Lauderdale, according to an arrest affidavit. There, a family member saw her and returned her to Vero Beach, where a doctor confirmed she has herpes.
Arita was arrested after he made "plans to come and meet the victim again in the near future and he would rent a room at a local hotel" where they could meet, reports show.
